"My house"
(The first stage)
1) Mission
The Presidential program "My house", has been prepared by the Ministry of refugees and accommodation of Georgia, the purpose of introduction and which realization is, in Georgia, on uncontrollable de facto territories, in particular in Autonomous republic Abkhazia and in region Tskhinvali to carry out the account immovable property and the property right to them. Maintenance of carrying out of the universal actions stipulated by the first point of 21-st article of the constitution of Georgia, approved in 2000 constantly operating committee GLUK on the basis of educational principles about violently displaced persons and recognized by the international norms of political both civil human rights and guaranteed by protection of the rights to the property and the inheritance.
2) Strategy of realization
With the purpose of the account of the real estate existing in Autonomous republic of Abkhazia and in region Tskhinvali, under the order of the President of Georgia №124 Ministry of refugees and accommodation of Georgia has prepared the project which has been approved by the government of Georgia and it is published in the form of the order from 14.02.06y.
1) The project enables IDP-s, according to the order and the form approvedby Minister of refugees and accommodation of Georgia to carry out declaring real estate belonging them in uncontrollable territory.
2) The data Specified in the declaration will be used for creation of geoinformation system of Autonomous republic of Abkhazia and region Tshinvali, with the same purpose will are carried out by a photo of shooting of the specified territory from the satellite.
3) With the purpose of maintenance of duly informing "refugees", potential investors (interested by realization transaction in Abkhazia and Tskhinvali) and societies, the above-stated information will be placed on the Internet on a web-page of the Ministry of refugees and accommodation of Georgia: www.chemisakhli.gov.ge www.mra.gov.ge
4) For realization of the given task, in the Ministry Management of restitution of real estate it is directly entrusted to them to work in the given priority direction.
3) Results
In the above-stated territories the inventory of real estate and the rights to them, enables to specify persons ( who are having the right of the order by the property on real estate, who owned the right of a residence/using real estate) and to protect their civil rights. In not controlling territory change of names of streets and numberings of houses, and also settling by citizens of other countries intensively is conducted. In the further, in order to prevent not completed civil disputes with citizens of other countries on real estate, the Ministry on the web-page with use of geoinformation system places and specifies the list of that real estate which belong to "refugees" or (in not controlling territory to the physical and legal persons, having real estate). And also in case of existence of the information on names and citizenship those persons who have illegally grasped real estate belonged to "refugees" places and specifies the list of these persons and will declare their lawless, (trophy), that becomes the basis for unconditional evictions of actual owners of real estate (lawlessly intruded actual owner - the physical or legal person will be probably fined by judicial order and it is imposed on them a rent for using). The information placed in geoinformation system will be used in the Strasbourg international court as exact, necessary and duly means of reception of the information that will be true documentary and obvious acknowledgement of that the real estate of "refugees" was grasped by citizens of other countries. At the same time, in the specified territory the inventory of real estate enables the "refugees", at all not protected layer, to render high-grade legal and other kind the necessary help for reduction conformity of documents of the property rights to their real estate with the legislation of Georgia.
4) The Priority
Satellite photos of shooting, creation of scientific and technical archive of the Abkhazian Autonomous republic and region Tskhinvali, the account of state and other real estate. Revealing of the persons having the requirement of the property right to real estate, in the further for preparation of process of privatization. 6) Prospective terms of realization
For realization of the order of the President №124 from 14.02.06y. The stipulated spadework (process of declaring, shooting satellite photoes, drawing up of maps, lot sites, advertising works of information character, carrying out of trainings for masters and journalists and preparation of other necessary documents) will be lead during 1-2, years. And the basic registration works will be intensively carried out within 2006-2010 years. In region Tskhivali it is necessary to establish owners up to 5000 apartment houses which have left the real estate and about 100 state large industrial and other objects. In Abkhazia more than 120 000 inhabited houses/apartments, a cadastral map of the ground areas and real estate of state of different functional purpose.
7) End results
At actual restoration of the legislation of Georgia in territory of Abkhazia and region Tskhinvali, citizens of Georgia will have by the right the high-grade and technically specified document confirming the property right to real estate in the Georgian and Abkhazian languages (in Abkhazia) on the basis of which property questions will be settled and moving "refugees" in places of their constant residence is carried out. Improvement of databases of "refugees" will be carried out: with the purpose of drawing up of multilateral programs of rehabilitation, repatriation and integration with international donor organizations. And also revealing of real estate belonged the state and a long-term plan of revival of territory for development resort and other industrial infrastructures.
8) Criterion of an estimation
In the territory of Abkhazia and in region Tskhinvali the "persons" who are having the right of the requirement of the property of real estate will receive « the Registration certificate » on real estate and the enclosed plan of the ground area. Efficiency of the program can be estimated to the given out refugees and other "persons" by quantity of " the Registration certificate » and the enclosed plans of the ground area. Quantity of the inventory and the account of objects belonged the state.
